1. Without prejudice, M J Boyce Ltd (MJB) endeavours to provide and achieve the highest possible standard of quality, quantity and consistency to all of our clients.
  2. Personnel on hire are deemed to be operating under the Clients control and therefore should be instructed into the Clients own safe system of work and remain the Clients responsibility until the contracted period is complete.
  3. Operations carried out under the Clients instruction are at the Clients own risk. MJB will supply the skills requested. If the Client is not satisfied with the personnel supplied, MJB should be notified immediately. MJB will not accept any consequential costs against any event arising from circumstances beyond our control, whether due to actions, materials, faulty equipment or third party intervention.
  4. Contracted works are undertaken in the specific contract documents. It is accepted that the award of the contracted works is the Clients acceptance of MJB to deliver the contract within specification in a manner deemed efficient in all aspects of the operation to the agreed timescale. Deviations or alterations to the aforementioned subcontract are by mutual agreement and confirmed in writing by all parties.
  5. Rates are as per the current schedule of rates available on request. Rates do not include VAT.
  6. All timesheets should be signed by the customer’s representative. Customers are responsible for all charges, including overtime and bonus, if their representative has signed the timesheets.
  7. Standing shifts are charged for the day following a nightshift which finishes on Sunday-Thursday, including when the standing shift is Good Friday.
  8. All hires are charged on a shift basis for up to 10 hours worked. The shift rate is the minimum charge.
  9. MJB must be contacted immediately on the morning of the hire commencement if the customer deems that the operative supplied is unsuitable for the work required.
  10. Operatives are supplied to work under the customers control and supervision and the customer’s representative is responsible for quality matters
  11. All invoices are prepared weekly and due for payment within 21 days of the date of the invoice. Any amounts in dispute must be advised in writing to MJB within 14 days of invoice date. We reserve the right to apply a daily interest charge of 5% above the current Bank of England lending rate on all amounts overdue.
  12. Transport is provided with a maximum of 5 operatives per van. When more than 5 operatives are ordered, vans will be charged at a number divisible by 5.
  13. Only authorised MJB personnel are permitted to operate or drive MJB supplied items. The use of such items directly by the Client or any third party is strictly forbidden.
  14. Vehicles and equipment are only to be used in connection with hired operation and may not be re-allocated without prior written consent from MJB.
  15. Cancellation charges

Tuesday to Friday:

A cancellation charge will be applied if a booking is cancelled after 4.30pm on the day prior to the hire.

Saturday/Sunday/Monday:

A cancellation charge will be applied if a booking is cancelled after 4.30pm on the day prior to the hire.

  1. Notwithstanding any of the above, Client, site and job specific conditions may be agreed and applied at the relevant time and notified in writing by all parties prior to commencement of any activities.
